This Privacy Notice describes how Applied English collects and uses personal data about you, in accordance with the General Data Protection Regulation 2016/679 (“EU-GDPR”), the Data Protection Act 2018, UK General Data Protection Regulation (“UK-GDPR”) and any other implementing laws, regulations and secondary legislation, as amended or updated from time to time, in the UK (“Data Protection Legislation”).

Applied English is registered with the Information Commissioners Office (ICO): number ZA683421.
For the purpose of the Data Protection Legislation and this Notice, Applied English is the ‘Data Controller’ and is responsible for deciding how it holds and uses personal data about you. Applied English is required under the Data Protection Legislation to notify you of the information contained in this Privacy Notice.
Applied English has appointed a Data Protection Contact who holds responsibility and authority to assist with enquiries in relation to this Privacy Notice and Applied English’s treatment of your personal data. Contact details are shown, below, in the Contact Applied English section.
3. How Applied English May Collect Your Data
Applied English obtains personal data about you when:
you request a quote or other proposal from Applied English in respect of the services it provides;
you, or your employer, or our clients engage Applied English to provide services and also during the provision of those services;

5. How Applied English Uses Personal Data it Holds About You

purposes necessary for the performance of its contract with you, or your employer, or Applied English’s clients and to comply with Applied English’s legal obligations.
the purposes necessary for the performance of its contract with its client. This may include processing your personal data where you are an employee, subcontractor, supplier or customer of Applied English’s client.
the purposes of its own legitimate interests provided that those interests do not override any of your own interests, rights and freedoms which require the protection of personal data. This may include processing for marketing, business development, statistical and management purposes.

Applied English may also process your personal data without your knowledge or consent, in accordance with this Notice, where Applied English is legally required or permitted to do so.
5.1. Data Retention
Applied English will only retain your personal data for as long as is necessary to fulfil the purposes for which it is collected; when assessing the retention period, appropriate for your personal data, Applied English takes into consideration:
the requirements of its business and the services provided;
any statutory or legal obligations;
the purposes for which Applied English originally collected the personal data;
the lawful grounds on which Applied English based its processing;
the types of personal data Applied English has collected;
the amount and categories of your personal data; and
whether the purpose of the processing could, reasonably, be fulfilled by other means.
5.2. Change of Purpose
In circumstances where Applied English needs to use your personal data for any reason, other than for the purpose for which Applied English collected it, Applied English will only use your personal data where that reason is compatible with the original purpose. Should it become necessary to use your personal data for a new purpose, Applied English will notify you and communicate the legal basis which permits it to do so before any new processing commences.
6. Data Sharing
Applied English will share your personal data with Third Parties where it is required by law, where it is necessary to administer the relationship between Applied English and you, or where Applied English has another legitimate interest in doing so.
Such parties includes Applied English’s service providers for activities including, but not limited to: IT and cloud services, professional advisory services, administration services, marketing services and banking services.
All of Applied English’s service providers are required to take commercially reasonable and appropriate security measures to protect your personal data. Applied English only permits its service providers to process your personal data for specified purposes and in accordance with Applied English’s instructions.
Applied English may share your personal data with additional, specific, Third Parties, e.g. in the context of the possible sale or reorganization of its business, or with a Regulator, or to otherwise comply with the law.
7. Transfers of Personal Data Outside the UK/EEA
Applied English may transfer the personal data we collect about you to countries outside of the UK and European Economic Area (EEA), where there is an Adequacy Decision by the European Commission (EU) or Secretary of State (UK), in accordance with article 45 of GDPR, in relation to such countries and territories and therefore they are deemed to provide an adequate level of protection for your personal information for the purpose of the Data Protection Legislation.
Where there is no Adequacy Decision, or other mechanism approved by the European Commission or UK Secretary of State in relation to certain countries such they are not be deemed to provide an adequate level of protection for your personal information for the purpose of the Data Protection Legislation, Applied English shall have put in place measures to ensure that your personal data is treated by those Third Parties in a way that is consistent with, and which respects, the Data Protection Legislation, such as Binding Corporate Rules (BCR) or Model Contract Clauses (also known as Standard Contract Clauses).
8. Data Security
Applied English has put in place commercially reasonable and appropriate security measures to prevent your personal data from unauthorised access, alteration, disclosure or other use. In addition, Applied English limits access to your personal data to such employees, agents, contractors and authorised Third Parties which have an authentic business need to know and are subject to confidentiality terms.
Applied English has put in place its procedures to deal with any suspected data breach and will notify you, and any applicable regulator, of a suspected breach where Applied English is legally required to do so.
9. Your Data Protection Rights
9.1. Changes in Your Personal Information
The personal data Applied English holds about you must be accurate and current. Should your personal information change, please notify Applied English of any changes, of which we need to be made aware, by getting in touch, using the Contact Applied English information, below.
9.2. Your Rights in Law
Request Access to your personal data. This enables you to receive details of the personal data Applied English holds about you and to check that Applied English is processing it lawfully.
Request Correction of the personal data that Applied English holds about you.
Request Erasure of your personal data. This enables you to ask Applied English to delete or remove personal data where there is no reason for Applied English to continue to process it. You also have the right to ask Applied English to delete or remove your personal data where you have exercised your right to object to processing, as follows.
Object to processing of your personal data where Applied English relies on a legitimate interest (or that of a Third Party) and there is something about your particular situation which makes you want to object to processing on this lawful basis. You also have the right to object where Applied English is processing your personal information for direct marketing purposes.
Request the Restriction of processing of your personal data. This enables you to ask Applied English to suspend the processing of personal data about you, in situations of disputed accuracy, unlawful processing, exercising or defending a legal claim. Restricted personal data is not deleted unless the right to Erasure is exercised.
Request the Transfer of your personal data to you, or another data controller, if the processing is based on consent, carried out by automated means and this is technically feasible.

You will not have to pay a fee to access your personal data or to exercise any of your other rights in law. However, Applied English may charge a reasonable fee if your request for access is without foundation, vexatious or excessive; Applied English may refuse to comply with any request in such circumstances.
Applied English may need to request specific information from you to help it confirm your identity and ensure your ability and right to access the personal information or to exercise any of your other rights in law. This is a proportionate security measure, to prevent unauthorised disclosure of personal information.
10. Withdrawal of Consent
Solely in circumstances where you may have provided your consent to the collection, processing and transfer of your personal data for a specific purpose, you have the right to withdraw your consent for that specific processing, at any time. To withdraw your consent, please email or write to Applied English’s Data Protection Contact, as shown in the Contact Applied English section, below.
Once Applied English has received your notification that you have withdrawn your consent, Applied English will no longer process your personal information for the purpose, or purposes, for which you originally provided the consent, unless we have another legitimate basis, in law, for doing so.

If Applied English makes changes to its Privacy Policy, corresponding changes will be reflected in this Privacy Notice.

Any References to "we" and "us" and "our" relate to Willing Lightbulb Limited, trading as Applied English. References to "you" and "your" relate to the Student as customer.
These terms and conditions should be read alongside the Privacy Notice.
1. Purchasing Lessons
Lessons must be purchased in blocks (“Lesson Pack”) with a minimum order quantity of six lessons.
Lesson Fees are non-refundable.
Each Lesson Pack comes with an expiry date; all lessons in the pack must be taken before the expiry date.
Applied English issues an authentic invoice and payment must be made, as directed on the invoice, in full and in Sterling (GBP) at least 48 hours before the scheduled date of the first lesson.
Applied English does not warrant, nor guarantee, to you that you will obtain a particular result, professional qualification or employment opportunity from your purchase and completion of any of its language teaching services.
2. Attending Lessons
All lessons are scheduled on the basis of one hour per lesson. Requests for longer teaching time, for all lessons in a Lesson Pack, may be considered upon request, subject to availability and at a negotiated cost.
The student agrees to a timetable of lessons prepared by Applied English and must attend at the dates and times advised.
A student's failure to attend at a scheduled start time, for any reason, forfeits the corresponding lesson.
Student requests to change a scheduled lesson date and / or time must be made in writing no later than 48 hours prior to the scheduled lesson.
Changes to scheduled lessons are at the sole discretion of Applied English; any agreement to change is subject to availability.
In any event, scheduled lessons may not be changed to dates beyond the Lesson Pack expiry date.
3. Technical Arrangements
Lessons are conducted using robust and common video software, namely : Microsoft® Teams™ and Google® Meet™, for combined voice and video interaction.
Students are responsible for ensuring that all software, computer equipment and internet connection available to them operates correctly, in order to participate in each lesson.
Applied English is not responsible for external connectivity of any kind. Any lesson that is unable to start, or complete, because of student connectivity issues will be classed as a failure to attend.
4. Agreement and Cancellation
A legally binding agreement exists between the parties when Applied English has :
a. accepted your offer to purchase services from us by sending you an email confirming the purchase; and
b. received payment of the relevant fee.
Your rights in respect of purchases are covered by the Consumer Contracts (Information, Cancellation & Additional Charges) Regulations 2013.
The Regulations allow you 14 days (starting after the day in which you entered the agreement) to cancel the contract (the “Cooling Off Period”), unless it is agreed that the services will commence within that 14 day period.
Purchasing a Lesson Pack that commences within the 14 day Cooling Off Period means that the Regulations will not apply and you will therefore be giving up your right to cancel. Money paid will therefore not be subject to a refund upon cancellation. In these circumstances, you consent to the commencement of our services (being the arrangement and design of the course for you) within the Cooling Off Period, pursuant to Regulation 13(1)(a) of the Regulation.
5. Legal Form
Applied English is a commercial web-presence and a trading style of Willing Lightbulb Limited, registered in England and Wales under Company number 07772179 and whose registered address is located at : 54 Harnham Road, Salisbury, Wiltshire, SP2 8JJ, UK.
These General Terms and Conditions constitute the entire agreement between you and Applied English.
Any failure by Applied English to exercise or enforce any right or provision of the terms shall not constitute a waiver of such right or provision.
These terms and the relationship between you and Applied English shall be governed by the laws of England and the English courts shall have exclusive jurisdiction over any dispute.
Applied English shall not be held responsible for any delay or failure to perform or comply with its obligations under these terms if the delay or failure arises from any cause, which is beyond its reasonable control.
Applied English reserves the right to vary the terms from time to time, such variations becoming effective immediately upon posting to this website and, by continuing to use it, you will be deemed to have accepted any and all such variations.
Clauses 6, 7 and 8 shall survive termination of these Terms and Conditions.
6. Confidentiality
Each party shall keep the other party’s Confidential Information strictly confidential and not use it otherwise than for the purposes of these General Terms and Conditions, and shall return it on demand and not retain copies of it.
7. Intellectual Property
All original course materials, remain the intellectual property of Applied English, whether adapted, written for, or otherwise customised for individual students.
Students may not record, copy, modify, reproduce, re-publish, sub-licence, sell, upload, broadcast, post, transmit or distribute, in any medium, any of the course materials.
8. Liability
Applied English will provide tuition with its reasonable care and skill in accordance with the description(s) set out on this Website.
Applied English accepts no liability for any:
inaccuracy or misleading information provided in the course materials nor any reliance by any party on any such information;
loss or corruption of data;
loss of profit, revenue or goodwill; or
indirect, special or consequential loss arising from any breach of these General Terms and Conditions
Except to the extent that they are expressly set out in these General Terms and Conditions, no conditions, warranties or other terms shall apply.
